Costs Management Changes. Are You Ready?

Amendments[1] to the Civil Procedure Rules Costs Management provisions[2] come into force on 6 April 2016 and are applicable in respect of proceedings commenced on or after that date.

The key changes:-

  • In addition to exchanging and filing Budgets parties are required to file agreed Budget Discussion Reports
  • Claims made by or on behalf of a person under the age of 18 are excepted from the Costs Management provisions. Such exception will continue upon a child reaching majority, unless the Court orders otherwise
  • In claims of less than £50,000[3] the filing and exchange of Budgets will be required to take place at the point of Directions Questionnaires
  • In any other cases the filing and exchange of Budgets will be required to take place not later than 21 days before the first case management conference
  • Where a party (other than litigants in person) have filed and exchanged a Budget, an agreed Budget Discussion Report must be filed no later than 7 days before the first case management conference

The sanctions[4] for failure to file a Budget remain. As such it is critical that all firms are aware of, have systems in place to deal with and fully comply with the pending new provisions.
